Asbestos - related claims:

We are currently continuing the fight together with mesothelioma victims and their families for their right to claim compensation. Mesothelioma is a cancer brought on by exposure to asbestos fibres and is usually fatal.

In 2002 the insurance industry argued that if a person was exposed to asbestos by more than one company during their working life, they should not be able to claim full compensation from only one of those companies. This attempt failed; however, the insurers did not give up and in 2006 they tried again.

When the House of Lords reviewed this claim again in May 2006, they agreed with the insurers and decided that if one or more of the companies responsible for exposing the mesothelioma sufferer to asbestos was not insured or was not traceable then they could not claim the full amount of compensation.

Thompsons were devastated at the ruling which meant that victims of the fatal asbestos cancer would receive massive cuts in their compensation, while the insurers would save millions of pounds.

In most cases, employers knew of the dangers they were exposing their workers to when they asked them to work with asbestos without the necessary protective clothing, so Thompsons were not prepared to accept the House of Lords' decision.

Thompsons continued to campaign with the trade unions and the victims of asbestos related diseases. Together they lobbied government and highlighted the facts to make everyone aware of the injustice.

In June 2006, the hard work paid off and the Prime Minister announced that he would amend the Compensation Bill to overturn the decision made by the House of Lords and restore the right to full compensation for Mesothelioma sufferers.

Thompsons are now pressurising the Government to act swiftly to ensure that some victims don't miss out simply because their claim is settled before the Compensation Bill is amended.
